1 Introduction
Welcome to Tutorly ("we", "our", "the Platform"). Tutorly is an online marketplace operated in Switzerland that connects students with qualified tutors for private tutoring sessions.
By accessing or using our platform at www.tutorly.ch, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.
If you do not agree to these terms, please do not use our platform.
2 Company Information
Tutorly is based in Switzerland and operates in accordance with Swiss law.
3 Definitions
- "Platform" refers to the Tutorly website and all related services available at www.tutorly.ch
- "Student" refers to any user who books tutoring sessions through the Platform
- "Tutor" refers to any individual who offers tutoring services through the Platform
- "Session" refers to a confirmed tutoring appointment booked through the Platform
- "Booking" refers to a confirmed reservation of a tutoring session
4 Account Registration
To use our services, you must create an account on the Platform. You agree to:
- Provide accurate, current and complete information during registration
- Maintain and update your information to keep it accurate
- Keep your password secure and confidential
- Notify us immediately of any unauthorised use of your account
- Be at least 18 years old, or have parental consent if under 18
Tutorly reserves the right to suspend or terminate accounts that violate these terms.
5 Booking Policy
When a student books a session with a tutor through the Platform:
- The booking is confirmed only after successful payment processing
- Both the student and tutor will receive a confirmation email to their registered email address
- The student agrees to attend the session at the confirmed date and time
- The tutor agrees to be available and prepared for the session
6 Cancellation and Refund Policy
⚠️ IMPORTANT: Sessions must be cancelled at least 2 hours before the scheduled start time to be eligible for a refund.
6.1 Student Cancellations
- Cancellations made MORE than 2 hours before the session: full refund issued
- Cancellations made LESS than 2 hours before the session: no refund, non-negotiable
- No-shows (student does not attend without cancelling): no refund
- Date or time change requests made less than 2 hours before the session: not permitted
6.2 Tutor Cancellations
- If a tutor cancels for any reason: student receives a full refund
- Repeated tutor cancellations may result in removal from the Platform
6.3 Rescheduling Policy
Rescheduling of sessions is subject to the same conditions as cancellations:
- Rescheduling requests made MORE than 2 hours before the session: permitted, subject to tutor availability
- Rescheduling requests made LESS than 2 hours before the session: NOT permitted under any circumstances
No exceptions to the 2-hour cancellation policy will be made, regardless of the reason provided.
7 Payments
All payments on the Platform are processed securely through our payment provider (Stripe). We accept:
- Twint
- Swiss debit and credit cards
- Major international credit cards (Visa, Mastercard)
All prices on the Platform are displayed in Swiss Francs (CHF) and include applicable taxes.
Tutorly charges a platform fee on each transaction to cover operational costs. This fee is displayed clearly before payment confirmation.
8 Tutor Responsibilities
Tutors registered on the Platform agree to:
- Provide accurate information about their qualifications, experience and expertise
- Deliver sessions professionally and as described in their profile
- Arrive or connect on time for all booked sessions
- Maintain appropriate conduct with all students
- Not solicit students to book sessions outside the Platform
- Comply with all applicable Swiss laws and regulations
9 Student Responsibilities
Students using the Platform agree to:
- Provide accurate information when creating an account and booking sessions
- Attend sessions at the confirmed time
- Treat tutors with respect and professionalism
- Not record sessions without the tutor's explicit consent
- Not attempt to contact or book tutors outside the Platform
10 Prohibited Conduct
The following conduct is strictly prohibited on the Platform:
- Providing false or misleading information
- Harassment, abuse or inappropriate behaviour towards other users
- Attempting to circumvent the Platform's payment system
- Sharing login credentials with third parties
- Using the Platform for any unlawful purpose
11 Intellectual Property
All content on the Tutorly Platform, including but not limited to logos, text, graphics and software, is the property of Tutorly and is protected by Swiss and international intellectual property laws.
Users may not reproduce, distribute or create derivative works without our express written permission.
12 Privacy and Data Protection
Tutorly is committed to protecting your personal data in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the General Data Protection Regulation (GDPR).
By using our Platform, you consent to the collection and use of your data as described in our Privacy Policy, available on our website.

- We do not sell your personal data to third parties

13 Limitation of Liability
Tutorly acts as an intermediary platform connecting students and tutors. We are not responsible for:
- The quality or outcome of tutoring sessions
- The accuracy of tutor profiles and qualifications
- Any disputes between students and tutors
- Technical issues beyond our reasonable control
To the maximum extent permitted by Swiss law, Tutorly's total liability shall not exceed the amount paid by the user for the relevant session.
14 Dispute Resolution
In the event of a dispute between a student and a tutor, both parties agree to first attempt resolution directly. If unsuccessful, Tutorly may assist in mediation but is not obligated to resolve disputes between users.
For disputes with Tutorly directly, Swiss law shall apply and the courts of Switzerland shall have exclusive jurisdiction.
15 Changes to These Terms
Tutorly reserves the right to modify these Terms and Conditions at any time. Users will be notified of significant changes by email. Continued use of the Platform after changes constitutes acceptance of the new terms.
